NEW YORK BILL ALLOWS COMMISSIONERS TO SET LAWS AND RULES CONCERNING THE CBD INDUSTRY

There is a generalized increase in the use of CBD products than never before. Lawmakers are looking at the possibilities of changing the laws concerning this industry to suit the needs of everyday users. While US congress members are deliberating on how to make CBD more legal, states like New York have passed a bill that is going to put a commissioner in place to set forth laws and rules that will affect the hemp industry.

According to the terms state in the bill, “ The commissioner may authorize the growing or cultivation of industrial hemp as part of agricultural pilot programs conducted by the department and/or an institution of higher education to study the growth and cultivation, sale, distribution, transportation and processing of such hemp and products derived from such hemp provided that the sites and programs used for growing or cultivating industrial hemp are certified by and registered with the department.”

It is quite unclear if this new bill will make CBD more popular or not, but most CBD enthusiasts and users believe this move will grant more companies a chance to explore the benefits of the growing CBD market as long as they meet the requirements.

There are several confusions concerning the use and distribution of CBD products for the treatment and control of medical conditions. Taking a more in-depth look at the new bill, it was clearly stated that the industrial hemp used for research purposes must be sourced from an authorized New York State industrial hemp producers. This means that only hemp from accredited growers must be used in New York states.

Furthermore, all hemp for extracts can only be sourced from authorized New York state industrial hemp producers. With the move, New York may soon experience an increase in the number of accredited and certified hemp growers. The new bill strictly prohibits the cultivation, processing, production, distribution, and sale of industrial hemp or products relating to industrial hemp unless licensed biennially by the commissioner or authorized by the commissioner as part of an agricultural research pilot program established by the new bill.

Also, application for a license to grow industrial hemp shall be made upon a form prescribed by the commissioner, accompanied by a per-acre license fee and a non-refundable application fee of five hundred dollars ($500). This puts the commissioners more in charge of all regulations concerning the cultivation, distribution, and sale of industrial hemp.

While putting the commissioners in charge of the hemp industry may ease the stress of obtaining a license to grow, distribute industrial hemp and its related product, there is a rising concern on the effectiveness of this law.
